Finisar-Infineon Merger Cleared

SUNNYVALE, Calif., Aug. 3 -- Finisar Corp. and Infineon Technologies AG, of Munich, have received clearances from antitrust and merger control authorities in the US and Europe to proceed with Finisar's previously announced acquisition of Infineon's fiber optics business (See "Finisar to Buy Infineon Fiber Unit," Photonics.com, April 30). Finisar said the waiting period under the Hart-Scott-Rodino Antitrust Improvements Act expired on July 15, and the merger control and antitrust regulatory authorities of the Federal Republic of Germany and the Czech Republic have notified Finisar and Infineon Technologies AG that they will not initiate proceedings with respect to the acquisition.

The acquisition remains subject to approval by Finisar's stockholders; Finisar said its annual meeting is expected to be held in late September or October.

Finisar, based in Sunnyvale, Calif., makes fiber optic subsystems and network performance test systems that enable high-speed data communications for networking and storage applications over Gigabit Ethernet local area networks, fiber channel storage area networks and metropolitan area networks using IP and SONET/SDH-based protocols.
