Court Sides with Corning in Patent Infringement Case

CORNING, N.Y., Nov. 18 -- Corning Inc. announced that the US District Court for the District of Delaware has ruled that SRU Biosystems of Woburn, Mass., infringed on a patent exclusively licensed to Corning for optical biosensors that enable label-independent detection of chemical, biochemical and biological substances in a sample. The court ruled that the patent is valid, and also found that SRU induced patent infringement through its testing activities with a potential customer.

Corning licensed the patent from Artificial Sensing Instruments (ASI) AG of Zurich, Switzerland, and Corning and ASI filed the lawsuit in July 2003 to stop SRU's infringement. A schedule has been set by the court for completion of the remaining issues in the case.

Corning says beta testing of Corning's Epic system, a detection platform based on the patent, are currently being conducted at some pharmaceutical, biotechnology and academic institutions. It anticipates the commercial launch of the product in the fourth quarter of 2006.
